***The title of ownership and the right to limited
AKC registration on any dog sold under this contract
Agreement will remain at the Seller's (Breeder)
discretion until said Shih Tzu has been spayed/neutered
by a
Licensed veterinarian.
***Seller's Conditional Release and Guarantee):
*** Provide proper inoculation/vaccinations,
including Lepto, a 7 way injection per our vet’s
protocol ) prior to the sale and placement
Of said Shih Tzu.
*** Said Shih Tzu will be healthy at the time
of sale as evidenced by the USDA health Certification issued
by a licensed Veterinarian. Upon arrival to the
Buyer, the buyer is required to have this baby
certified healthy by a licensed veterinarian
of the health of the baby. This period will not
Exceed seventy-two (72) hours. Within this time
period, the Buyer must have an accredited veterinarian
Examine said Shih Tzu. The Buyer must provide
a copy of said Shih Tzu's written health examination
results to The Seller, within seven (7) days
from the time of the examination.
*** Seller guarantees that said Shih Tzu will
be free of known genetic defects as validated
by a licensed veterinarian one (1)year, the Buyer
must submit written proof from the licensed veterinarian
to the Seller within fifteen (15) days from the
date of the known genetic defect being found
and diagnosed by two (2) veterinarians. If found
to have a genetic defect, the Seller will replace
said Shih Tzu with another
One of equal quality and price that is currently
available or as soon as a litter is available..
*** Seller guarantees that said Shih Tzu meets/exceeds
the standards of akc at akc,org or on the web-site.
It is clearly understood that the seller shall
NOT assume liability for veterinary expenses
which buyer chooses to incur unless prior arrangements
have been made, and in which case seller reserves
the right to choose the treating veterinarian.
The seller shall NOT assume liability for shipping
expenses which are incurred by the buyer unless
prior arrangements have been made.
***Buyer agrees to provide regular veterinary
care as well as the proper daily maintenance
to keep the puppy in good health. Buyer agrees
to inform seller at once if problems develop
and to follow all veterinary recommendations
for their solution. If these things are not done,
all guarantees and stipulations are null and
void.
***Congenital disease: If a congenital disease
develops within 1 year of purchase {Ozark Shih
Tzu’s reserves the right to have the animal
examined by a vet of our choice at our expense
to confirm the diagnosis} [This does not apply
to faults or defects, which were disclosed at
the time of purchase]
***This does not include the presence of internal
or external parasites or injury after the puppy
left the seller.
***We highly recommend that the diet we have
recorded in detail for you on the back of your
health record for the baby be followed. If the
diet is not followed all issues contained in
this or any other contract becomes null and void.
***Please note that during times of stress,
such as going into a new home, pups can exhibit
temporary signs of illness which may include
sneezing, runny nose, watery eyes, diarrhea,
and/or constipation. To help reduce these signs
of stress feed the puppy the diet he/she was
on at the sellers’ home. Offer bottled
water, as well as taking reasonable steps to
reduce the stress. These pups are used to being
held and loved when they are upset. This will
be the beginning of bonding and trusting of the
new home and caregiver. You can also reduce stress
by slowly introducing them to the home, and members
of the household, as well as limiting strangers’ time
with them until they have had some adjustment
time and trust and bonding has at least begun.
***The Seller reserves his/her right to
Obtain a second opinion by having his/her own
veterinarian examine said Shih Tzu at the Buyer's
expense at any time.
:
*** Once pregnancy is confirmed, the Seller will
accept a puppy deposit in the amount based on
the full price of the baby.
***The choosing of the puppies will be determined
in the order deposits are received. The Seller
reserves his/her right to pick Show or breeding
quality male or female puppy from all owned and
co-owned litters before deposits.
*** If the Seller cannot provide the Buyer with
a puppy (i.e. Buyer reserved a female puppy
but only
Males are born from that breeding), the
Buyer has the option to choose a puppy out of
the current litter of the sex not chosen, or
from the next available litter.
If the Buyer does not choose a puppy from the current litter, and not
the next available litter, then the Buyer forfiets his/her deposit in full.
*** If said Shih Tzu does not meet the conditions
stated , the following
Replacement options may apply:
* Once the Seller (Breeder) receives proof of
spaying/neutering of said Shih Tzu, the Buyer
will be
Entitled to a replacement puppy of equal quality
and price from the next available (first
or second) litters (at the Breeder's discretion).
The Buyer may accept an older dog if available,
or a puppy from the opposite sex to
said Shih Tzu being replaced. The replacement
puppy will be placed under the same terms and
conditions of this contract as the former
pup was.
* If the Buyers prefers to place said Shih Tzu
(after spaying/neutering), and written
proof has been
received by the Breeder) in a good loving home.
The Buyer must provide the Seller with the new
owner’s
Full name, drivers license number, home address
and telephone number. AKC registration papers
will be returned to the Seller/Breeder.
***Spay/neuter contract:
* The Seller must receive within 1 year receipt
of written proof from a licensed
Veterinarian, of said Shih Tzu's spaying/neutering
.
***Change of Title of Ownership:
* If the Buyer decides to change said Shih Tzu's
title of ownership, the Seller will be given
first right of
Refusal with no cost to the Seller. If the Buyer
decides to place said Shih Tzu in a good loving
home, the
Buyer must provide the Seller with the new owners'
full name, driver’s license number, complete
mailing
Address and telephone number. No change of title
of ownership will be tolerated unless said Shih
Tzu has
Been spayed/neutered and the new owner's information
have been received by the Seller (Breeder).
*** The Buyer is responsible and liable for all
shipping costs, for any reason.
***Buyer's Agreements, Terms and Conditions:
* In the event an accidental breeding occurs,
the pregnancy will be terminated by a licensed
veterinarian, and a copy of this procedure must
be sent to the Seller/Breeder within 10 days
of the termination of the pregnancy. The said
Shih Tzu must be spayed/neutered at that time
The Seller/Breeder will be immediately released
from any guarantees and responsibilities to said
Shih Tzu...
* The Buyer agrees NOT to have said Shih Tzu:
1. Used as a guard dog for any business
2. Chained in any way. Confined for any extended
time, no longer than 9 hours at the most to allow
work/school,etc…
*This dog/puppy is NEVER to be kept in an outside
situation for any reason outside the home. This
breed is never to be allowed to live outside.
This is a house dog ONLY.
3. Attack trained
4. Used for dog fights
5. Abuse of any kind will not be tolerated. These
babies respond to love and will do its’ best
to do any thing you ask of it, but even screaming
yelling are also forma of abuse.
*** The Buyer understands that said Shih Tzu
will become a small and unprotected pet. Due
to said Shih Tzu's size and lack of the ability
to protect itself the buyer must use caution
with this dog when introduced to strangers. The
Buyer commits to be consistent with the socialization
that has been started by the Seller/Breeder and
protect this Shih Tzu at all times... The Buyer
understands that
He/she must teach children and other adults not
to tease said Shih Tzu. When children are present,
the Buyer will ensure that children are under
adult
Supervision AT ALL TIMES the children and said
Shih Tzu are together for protection of said
Shih Tzu.
*** The Buyer binds him/herself to take good
and reasonable care of said Shih Tzu by following
the Seller's
(Breeder's) feeding recommendations and veterinarian
inoculations (must provide veterinarian care
Throughout said Shih Tzu's life).
*** The Buyer agrees to house and control said
Shih Tzu (on harness and lead when off premises)
at all times. Buyer agrees to keep said Shih
Tzu within a secure fenced in yard
(No less than six (6') feet of height) with plenty of shade and clean
water, and not allowed to be outside alone or for short periods of time only.
To prevent said Shih Tzu from escaping and to also provide protection (at all
times) to said Shih Tzu against the elements, and possible predators.
*** At no time will said Shih Tzu be chained,
nor allowed to run loose and off lead outside
a secured fence.
*** The Buyer also agrees to abide by the Shih
Tzu Association and the AKC code of ethics for
the breed
*** the Buyer agrees to notify the Seller of
change of home address, work and home phone numbers
Within seven (7) days of the change-taking place.
*** Any violation to any of the terms and conditions
stated on this contract will be subject to legal
Action and the Buyer will be responsible for
all court costs incurred. Further more, the Seller
(Breeder)
Reserves his/her right to repossess said Shih
Tzu and no refund will be due to the Buyer.
CONTRACT AMENDEMENT - Any changes or additional
terms to this Sales Contract must be made by
an Addendum and signed by all parties involved.
LAW TO APPLY - Both parties (Seller and Buyer)
agree that the law jurisdiction for this Sales
Contract
Will remain in Marion County, Arkansas. The Buyer
will be responsible for all attorneys’,
legal fees and court costs if necessary, and
Incurred while enforcing this contract.
